This article concerns the Lakeland Health case and the employer’s to re-classify licensed practical nurses (LPNs), from protected employees to statutory supervisors, so as to remove them from employee protections afforded by the National Labor Relations Act (NLRA). Under NLRA law, the article surveys National Labor Relations Board (NLRB), and court cases for determining supervisory status, a highly fact-intensive process. The author concludes that the erroneous decision classifying these workers as supervisors has adverse impacts on thousands of individuals, most of whom are female, and suggests strategies for labor to remedy this decision.
